Welcome to KAYA Zurich Apartments (“KAYA,” “we,” “us,” or “our”). We operate the website https://www.kayazurich.com (the “Site”) and provide short-term and long-term serviced accommodation in Zurich, Switzerland (the “Services”). These Terms & Conditions (the “Terms”) govern your use of our Site and your booking, stay, and related interactions with our apartments. By accessing our Site or by making a reservation or staying at a KAYA Zurich apartment, you agree to be bound by the Terms outlined below. If you do not agree with these Terms, please discontinue your use of our Site and Services.
1. Definitions
- “Guest,” “You,” “Your”: The individual(s) or entity(ies) who use the Site, reserve an apartment, or stay at KAYA Zurich Apartments.
- “Accommodation,” “Property,” “Apartment”: The serviced apartment(s) provided under the KAYA Zurich brand.
- “Booking”: The reservation of an apartment, whether directly through the Site or through authorized third-party platforms.
- “Stay”: The period you occupy the apartment.
2. Acceptance of Terms
- By using the Site or our Services, you acknowledge that you have read, understood, and agree to these Terms, along with any other policies referenced (including our Privacy Policy if available).
- If you are making a Booking on behalf of other persons, you are responsible for ensuring that all guests are aware of and agree to these Terms.
3. Modifications to Terms
- KAYA reserves the right to modify or update these Terms at any time, at its sole discretion.
- Any changes will be effective immediately upon posting on the Site. Your continued use of the Site or Services after we post any updated Terms signifies your agreement to the modifications.
- If material changes occur, we may provide additional notice (e.g., via email or prominent notice on our Site).
4. Eligibility
- To make a reservation or use our Site, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is older.
- You represent and warrant that you have the right, authority, and capacity to enter into legally binding agreements.
5. Bookings and Reservations

- You can make a Booking directly through our Site or via authorized third-party booking platforms (e.g., Booking.com, Airbnb, Expedia).
- The Terms & Conditions from third-party platforms may apply in addition to these Terms.

- You agree to provide accurate and complete information during the Booking process, including name, contact details, and payment information.
- You are responsible for updating your information if it changes before or during your Stay.

Confirmation
- A Booking is considered confirmed only after we receive your payment (partial or full) and we issue a confirmation email.

Rates & Taxes
- The total price for your Booking is displayed during the reservation process and includes applicable taxes and fees, unless otherwise noted.
- Any additional local taxes or fees not included in the quoted rate will be disclosed prior to or during check-in.
6. Pricing & Payment

Accepted Payment Methods
- We accept major credit cards, debit cards, bank transfers, and other payment methods as indicated on our Site.
- Payment must be made in Swiss Francs (CHF) unless otherwise specified.

Payment Schedule
- A deposit may be required to secure your Booking, and the remaining balance is usually due prior to arrival or upon check-in, as stated in your Booking confirmation.
- If full payment is not received by the specified due date, we reserve the right to cancel your Booking.

Security Deposits
- We may require a security deposit. The amount and payment method will be specified at the time of Booking.
- This deposit may be used to cover any damages or breaches of these Terms.

Late Payments
- Late payments may be subject to additional charges or fees as stipulated in the Booking confirmation or invoice.
7. Cancellation and Refund Policy

Guest-Initiated Cancellations
- Cancellation terms, deadlines, and fees will be stated at the time of Booking.
- For cancellations outside the free cancellation period (if any), the deposit or any pre-paid amounts may be non-refundable.
- In the event of an early departure, we may not issue a refund for unused nights unless otherwise stated.

KAYA-Initiated Cancellations
- We reserve the right to cancel or modify a reservation if we become aware of circumstances that make the accommodation unavailable for reasons beyond our control (e.g., natural disasters, government regulations, or force majeure events).
- In such rare cases, we will either offer a full refund or attempt to relocate you to a comparable property at no additional cost.

No-Shows
- If you fail to check in on your scheduled arrival date without prior written notice, your Booking may be considered a no-show, and all applicable cancellation fees will apply.
8. Check-In and Check-Out

Check-In
- Check-in details, including times and key collection procedures, will be outlined in your Booking confirmation or via pre-arrival emails.
- Early check-in may be available upon request, subject to availability and additional fees.

Check-Out
- Check-out time will be clearly stated in your Booking confirmation and within the apartment.
- Late check-out may be requested, subject to approval and additional fees.

Identification Requirements
- All guests may be required to provide a valid ID (passport, driver’s license, or government-issued identity card) upon check-in.
9. Guest Responsibilities

Conduct
- You and your fellow guests must conduct yourselves responsibly and lawfully during your Stay.
- Excessive noise, illegal activities, or disturbances that affect neighbors or the property are strictly prohibited.

Occupancy Limits
- The number of guests must not exceed the maximum occupancy stated in the Booking confirmation.
- Additional guests beyond the stated limit may result in extra charges or termination of the Booking.

Damage and Loss
- You are responsible for leaving the apartment in the condition it was in at check-in.
- Any damage or loss caused to the apartment, its contents, or common areas during your Stay will be charged to you.

No Smoking Policy
- Smoking inside the apartments is strictly prohibited. A penalty fee for deep cleaning and any damages may be applied if this policy is breached.

Pets
- Pets are not allowed unless specifically permitted in your Booking confirmation. If pets are allowed, additional rules and fees may apply.

Cleanliness
- Basic housekeeping is included, but you are expected to maintain general cleanliness during your Stay.
- Excessive cleaning required after check-out may result in additional fees.
10. Facilities and Amenities

Internet and Utilities
- Unless otherwise stated, rental rates typically include Wi-Fi and utilities (water, electricity, heating).
- We do our best to ensure all services function consistently; however, occasional disruptions may occur due to maintenance or factors beyond our control.

Laundry and Housekeeping
- Our apartments may offer laundry facilities (washer/dryer in-unit or communal).
- Housekeeping schedules will be communicated prior to your Stay; additional cleaning can be arranged for a fee.

Maintenance and Repairs

11. Guest Safety and Security

Personal Property
- You are responsible for safeguarding your personal belongings. We recommend securing valuables in a safe place.

Emergencies
- In case of an emergency, please contact local authorities (in Switzerland, dial 117 for police, 118 for fire, 144 for medical).
- We provide emergency contacts and instructions within each apartment.

Health and Medical Considerations
- Guests are responsible for their own health and medical needs during their Stay.
- If you have a medical condition, please ensure you have appropriate travel insurance or necessary supplies.
12. Force Majeure
KAYA shall not be liable for any failure to provide, or any delay in providing, Services due to unforeseen events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, government orders, pandemic restrictions, or natural disasters. If a force majeure event affects your Stay, we will make reasonable efforts to contact you and offer alternative arrangements, subject to availability.
13. Intellectual Property

- The Site and all content, including text, graphics, logos, icons, images, and software, are the intellectual property of KAYA or its content suppliers.
- You may not copy, reproduce, modify, distribute, display, or use any content from the Site for commercial or public purposes without prior written permission from KAYA.

- All trademarks, service marks, and trade names displayed on the Site or related to KAYA are the property of KAYA or other respective owners.

17. Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles.
- Any dispute arising out of or relating to these Terms, the Site, or the Services shall be subject to the exclusive jurisdiction of the competent courts in Zurich, Switzerland, unless otherwise required by applicable consumer protection laws.
18. Dispute Resolution

Amicable Settlement

Mediation/Arbitration
- If an amicable settlement cannot be reached, parties may agree to resolve the dispute through mediation or arbitration in Zurich, Switzerland.
- Nothing in this clause prevents a party from seeking urgent relief in a court of competent jurisdiction.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, it shall be deemed severed from the remaining provisions, which will continue in full force and effect to the extent permitted by law.
20. Waiver
No failure or delay by KAYA in exercising any right, power, or remedy will operate as a waiver of that right, power, or remedy, nor will any partial exercise preclude further exercise of the same or another right, power, or remedy.
21. Entire Agreement
These Terms and any policies referenced (such as our Privacy Policy) constitute the entire agreement between you and KAYA regarding your use of the Site and Stay at our apartments. They supersede all prior agreements, understandings, or representations.
